BY MEANS LIKELY TO PRODUCE GREAT BODILY INJURY – PC § 245(a)(4)


As assault that is “likely to produce great bodily injury” is a felony offense in California which can comes with a 4 year state prison sentence.  Great bodily injury is defined as physical injury suffered by the victim of a violent crime that causes a substantial risk of death, extended loss or impairment of a body part or function, or permanent disfigurement or a physical injury that is more serious than that ordinarily suffered in a battery.”  An assault “by means likely” in this context requires only proof that the assault committed was likely to produce great bodily injury, not that it actually did cause great bodily injury.  As with many assault crimes in California, this is a matter of degree and changes on a case by case basis.
